For the Supply and Installation of Patio, Shed and Steel Building Products

Effective Date: 1 June 2026
By accepting a quotation, paying a deposit, making any payment, instructing AWGC PTY LTD as trustee for the Jacaza Trading Trust (ABN 53 450 519 692), trading as Patio & Shed Kits WA ("AWGC"), to proceed, accepting delivery of goods, or accepting any services supplied by AWGC, the Customer agrees to be bound by these Terms and Conditions.
1. General
1.1All quotations, sales, supplies, installations and services are subject to these Terms and Conditions.
1.2All prices are inclusive of GST unless otherwise stated.
1.3Material supply and installation charges may appear on the same quotation or invoice but are deemed separate and distinct contractual components.
1.4AWGC reserves the right to amend quotations where site conditions, engineering requirements, measurements or specifications differ from those originally quoted.
1.5Quotations are valid for thirty (30) days unless otherwise stated in writing.
2. Customer Responsibilities
2.1The Customer is responsible for ensuring all measurements, plans, specifications and information supplied to AWGC are accurate.
2.2Any variation resulting from inaccurate information supplied by the Customer may result in additional costs.
2.3AWGC accepts no responsibility for measurements, plans or specifications supplied by third parties.
2.4The Customer is responsible for providing suitable access to the site for inspections, deliveries and installation works.
3. Plans, Drawings and Intellectual Property
3.1All drawings, designs, engineering documents, concepts, calculations, plans and specifications produced by AWGC remain the intellectual property of AWGC.
3.2Such documents may not be reproduced, copied, distributed or used without the written consent of AWGC.
3.3By supplying plans and drawings, the Customer authorises AWGC to reproduce and use those documents for engineering, permit and project-related purposes.
3.4AWGC cannot include any item or addition on plans that AWGC is not supplying (for example, roller doors).
3.5Draft plans are sent to owners for approval. Any amendments requested after the owner has approved the plans may incur an additional administration fee.
4. Payment Terms
4.1Payment schedules may consist of deposits, progress payments and final payments as determined by AWGC.
4.2No engineering, drafting, permit applications, manufacturing, procurement, delivery or installation work will commence until required payments have been received.
4.3AWGC reserves the right to suspend or delay any works where payments are overdue.
4.4All invoices are payable strictly in accordance with the payment terms specified on the invoice.
5. Material Release, Manufacturing and Dispatch
5.1All patio kits, shed kits, steelwork and associated materials must be paid for in full before any materials are released.
5.2No materials, steelwork, roofing sheets, wall sheets, flashings, gutters, accessories, engineering documents, certifications, drawings or associated products will be released, delivered, dispatched, collected or supplied until the full contract balance has been received and cleared in AWGC's nominated bank account.
5.3For supply-only contracts, full payment is required before any goods are released.
5.4For supply-and-install contracts, AWGC may require full payment for materials prior to delivery or commencement of installation.
5.5Upon receipt of full payment, steelwork components will be dispatched according to AWGC's manufacturing schedule.
5.6Roofing sheets, wall sheeting, flashings, gutters, downpipes and associated materials may be ordered and supplied following receipt of final payment.
5.7All quoted lead times commence only after cleared funds have been received.
5.8AWGC reserves the right to withhold materials, engineering, certifications, drawings and associated documentation until all monies owing have been paid in full.
6. Delivery, Collection and Risk
6.1Risk in all goods passes to the Customer immediately upon delivery, collection or departure from AWGC premises.
6.2The Customer is responsible for inspecting goods upon receipt.
6.3AWGC is not liable for damage occurring after delivery or collection.
7. Installation Conditions
7.1AWGC is not responsible for replacing pavers, turf, landscaping, irrigation systems or other surface finishes disturbed during installation.
7.2AWGC is not responsible for reinstating landscaping or site finishes unless specifically included in writing.
7.3Crane hire, scaffolding, traffic management, core drilling, specialised lifting equipment and similar items are excluded unless specifically stated.
7.4Any unforeseen site conditions, latent conditions or additional works required during installation may be charged as variations.
7.5Installation schedules may be affected by weather, site conditions, material availability or events beyond AWGC's control.
8. Contractors and Third Parties
8.1AWGC may recommend, refer or introduce contractors, engineers, surveyors or other service providers.
8.2Any contractor recommended by AWGC remains an independent contractor.
8.3AWGC provides no warranty, guarantee or representation regarding the workmanship, conduct, licensing, insurance, compliance or performance of any third-party contractor.
8.4The Customer acknowledges that any agreement entered into with a third-party contractor is separate from any agreement with AWGC.
8.5AWGC accepts no liability whatsoever for workmanship defects, structural defects, delays, property damage, injury, losses or claims arising from work undertaken by any third-party contractor, regardless of whether that contractor was recommended by AWGC.
9. Structural Responsibility
9.1Unless expressly contracted to undertake installation works, AWGC acts solely as a supplier of materials, engineering and associated services.
9.2AWGC accepts no responsibility for the construction, erection, installation, modification or alteration of any structure assembled by others.
9.3The Customer assumes full responsibility for ensuring that any structure is constructed in accordance with supplied engineering, Australian Standards, Building Code requirements and local authority requirements.
9.4AWGC accepts no responsibility for workmanship, installation methods, footing construction, site conditions, structural adequacy resulting from incorrect installation or deviations from supplied engineering.
9.5Once materials are supplied, the responsibility for construction quality rests entirely with the property owner and any party engaged to construct the structure.
10. Permits, Approvals and Compliance
10.1The property owner is solely responsible for obtaining and maintaining all permits, approvals, licences and consents required for the project.
10.2This includes, but is not limited to:
- Building permits
- Development approvals
- Planning approvals
- Council approvals
- Strata approvals
- Heritage approvals
- Neighbour consents
- Occupancy approvals
10.3Any assistance provided by AWGC in relation to permits, drawings, engineering or applications is provided as an administrative service only.
10.4Responsibility for obtaining approvals remains entirely with the property owner.
10.5AWGC accepts no responsibility for delays, costs, penalties, rectification works, demolition orders or losses arising from approval or compliance issues.
10.6Water Management Plans: Where water tanks or soakwells are added to plans prepared for the shire, the size, capacity and location of those tanks or soakwells are suggestions only for the purpose of the application. It is the sole responsibility of the owner to install the sufficient size required in a suitable location.
10.7BA7 – Notice of Completion: It is the responsibility of the owner/builder to complete the BA7 Notice of Completion form and confirm the current form and applicable timeframe with the relevant permit authority.
10.8Setback less than 900mm: Boundary-related requirements depend on the project and the applicable planning and building requirements. The owner must confirm what approvals and documentation are required for their property.
11. Variations
11.1Any change requested after acceptance of a quotation may result in additional charges.
11.2Variations must be approved by AWGC prior to implementation.
11.3AWGC reserves the right to adjust pricing where engineering requirements, site conditions or authority requirements change.
12. Cancellations and Returns
12.1Returned goods may be subject to restocking charges.
12.2Deposits are non-refundable once engineering, drafting, permit applications or manufacturing have commenced.
12.3Custom manufactured goods are generally non-refundable.
12.4Cancellation after materials have been ordered, manufactured or delivered may result in forfeiture of deposits and recovery of costs incurred.
13. Warranties
13.1Hot Dip Galvanised Steel Warranty: Two (2) years structural integrity against corrosion-related failure under normal conditions.
13.2Hot dip galvanising is an industrial finish and may contain visual imperfections including roughness, texture variation, runs or drips. These are not defects.
13.3Workmanship Warranty: Two (2) years on workmanship performed directly by AWGC.
13.4Powder Coating Warranty: Two (2) years against peeling, flaking and significant coating failure under normal conditions.
13.5Colorbond products are covered solely by the manufacturer's warranty.
13.6Warranty claims must be supported by proof of purchase and submitted promptly.
13.7AWGC may repair or replace affected products at its discretion.
14. Photography and Marketing
14.1The Customer grants AWGC permission to photograph works before, during and after completion.
14.2Such photographs remain the property of AWGC and may be used for marketing, advertising and promotional purposes.
15. Retention of Title
15.1Ownership of all goods supplied by AWGC remains with AWGC until all monies owing have been paid in full.
15.2AWGC may enter any premises where unpaid goods are located for the purpose of recovering those goods.
15.3The Customer indemnifies AWGC against claims arising from the recovery of unpaid goods.
16. Default and Debt Recovery
16.1If payment is not received within seven (7) days of the due date, all outstanding amounts become immediately due and payable.
16.2Interest may be charged at the rate prescribed under the Supreme Court Act 1932 (WA).
16.3The Customer is liable for all debt recovery costs including:
- Legal fees
- Debt collection fees
- Credit reporting fees
- Title searches
- Caveat fees
- Court costs
16.4AWGC may register defaults with credit reporting agencies including Equifax.
16.5AWGC may lodge caveats or pursue legal proceedings to recover outstanding amounts.
17. Personal Guarantee
17.1Where the Customer is a company, trust or other entity, directors, trustees and beneficiaries personally guarantee payment of all monies owing.
17.2Such persons indemnify AWGC against losses arising from non-payment.
18. Limitation of Liability
18.1To the maximum extent permitted by law, AWGC's liability is limited to repair, replacement or resupply of goods or services.
18.2AWGC shall not be liable for indirect, consequential, special or economic loss.
18.3AWGC shall not be liable for delays caused by suppliers, manufacturers, transport providers, government authorities, weather events or circumstances beyond its control.
18.4AWGC shall not be liable for the structural adequacy, installation quality, workmanship, permit compliance or approval compliance of any structure erected by third parties.
18.5Where goods are supplied without installation by AWGC, the Customer assumes all responsibility for the completed structure.
18.6The Customer indemnifies AWGC against all claims arising from construction, installation, certification, use or occupation of any structure not installed directly by AWGC.
19. Governing Law
19.1These Terms and Conditions are governed by the laws of Western Australia.
19.2Any dispute shall be determined exclusively by the Courts of Western Australia.
19.3Acceptance of a quotation, payment, written acceptance, verbal acceptance, email acceptance or conduct indicating acceptance constitutes acceptance of these Terms and Conditions.
